Trial for Terrorist Luis Posada Carriles Scheduled for MayThe notorious criminal will only have to answer to charges related to making false statements on his application for naturalization and lying during his interview Feb. 17, 2007 TEXAS, United Status, Feb 16.— Anti-Cuba terrorist Luis Posada Carriles will stand trial on May 11 to answer criminal charges related to making false statements on his application for naturalization and lying during the interview, the Spanish news agency EFE reported. Judge Katheleen Cardone, who will be in charge of the case, set the trial for May 1 in El Paso, Texas. But the court will not hear any of the serious crimes committed by Posada Carriles, whose long career as a terrorist is well known and about which Posada has even bragged about to the press, including the planning, together with Orlando Bosch, of the midair bombing of a Cubana passenger plane that claimed the lives of all 73 people on board. Posada’s new lawyer, Arturo Hernandez, said Thursday that the trial is scheduled to start on May 10, although sources with the court have indicated the proceedings will begin on May 11. Posada is being accused of attempting to obtain naturalization as a U.S. citizen unlawfully by making false statements on his application for naturalization. Hi is also charged with lying under oath during his naturalization interview with Department of Homeland Security (DHS) officials in 2006. The indictment also states that Posada claimed he entered the United States in May 2005 by land near Matamoros, Mexico and Brownsville, Texas. Yet, the U.S. government has evidence that Posada entered the United States by sea aboard the motor vessel Santrina and that he was accompanied by two other terrorists: Miami businessman Santiago Alvarez Fernandez-Magrinat and Osvaldo Mitat, both of Cuban origin. The court records show that the vessel had a four person crew, among them an FBI informer, and that it picked up Posada at Isla Mujeres, Mexico, and brought him to Miami in May of 2005. Posada spent two months in Miami before he was detained for migration irregularities. Both Alvarez and Mitat face charges for refusing to speak on their alleged participation in bringing Posada to the United States. In an attempt to gain his freedom, 79-year-old Posada has been resorting to numerous judicial recourses, including applying for U.S. citizenship. But Posada’s chances of being released were eliminated when a grand jury decided to indict him for lying under oath to U.S. government officers. The trial against Posada Carriles, who is currently being held at the Otero county jail in New Mexico, will be held in El Paso, Texas. |
Juicio al terrorista Luis Posada Carriles será en mayoSolo responderá a los cargos por presentar información falsa en su solicitud de nacionalización y mentir en la entrevista de dicho proceso 17 de febrero del 2007 TEXAS, Estados Unidos, febrero 16.— El juicio contra el terrorista anticubano Luis Posada Carriles será el próximo 11 de mayo para responder a los cargos criminales por presentar información falsa en su solicitud de nacionalización, así como por mentir en la entrevista del mismo proceso, dijo EFE. La juez Katheleen Cardone, que presidirá el caso, fijó además la fecha del primero de mayo para iniciar el proceso de selección del jurado en el tribunal de El Paso (Texas). Sin embargo, en el proceso no se mencionarán los graves delitos cometidos por Posada Carriles, cuyo prontuario como terrorista es ampliamente conocido, e incluso se ha jactado de él en más de una entrevista, incluyendo la organización junto con Orlando Bosch de la voladura de un avión de Cubana de Aviación, ocasionando la muerte de las 73 personas a bordo. EL nuevo abogado de Posada Carriles, Arturo Hernández, señaló el jueves, sin embargo, que el juicio comenzará el día diez de mayo, aunque los documentos judiciales difundidos ahora indican que la fecha es el once. Posada Carriles está acusado de haber dado información falsa cuando en 2006 presentó su documentación para solicitar la ciudadanía de Estados Unidos, y posteriormente mintió en la entrevista con funcionarios del Departamento de Seguridad Nacional. Sin embargo, el gobierno norteamericano tiene pruebas de que entró por mar a bordo de la embarcación Santrina, y que lo acompañaban otros dos terroristas, el empresario de Miami, Santiago Álvarez Fernández-Magriñat y Osvaldo Mitat, ambos de origen cubano. Los documentos judiciales indican que la embarcación tripulada por cuatro personas más, entre ellas un informante del FBI recogió a Posada en Isla Mujeres (México) para transportarlo a Miami, en marzo de 2005, en donde permaneció dos meses hasta ser detenido en mayo por estar indocumentado. Tanto Álvarez como Mitat enfrentan también cargos por negarse a declarar en torno a su presunta participación en la llegada de Posada Carriles como indocumentado a Miami. Desde el año pasado, Posada Carriles, de 79 años, ha recurrido a numerosos recursos judiciales para que las autoridades le permitan esperar al siguiente paso en libertad, entre ellas la petición de ciudadanía. Sin embargo, las oportunidades de que Carriles pudiera salir libre fueron canceladas, cuando un gran jurado decidió presentar cargos formales por mentir a funcionarios del gobierno norteamericano cuando estaba bajo juramento. El juicio contra Posada Carriles, quien actualmente se encuentra preso en la cárcel del Condado de Otero (Nuevo México) se llevará a cabo en El Paso (Texas).
