Posada case: the conspiracy continues by Jean-Guy Allard WHILE Luis Posada Carriles’ lawyers are maneuvering in Newark, New Jersey, to prevent the assassin from being charged with terrorism thus prompting his detention, former Salvadoran President Francisco Flores, who sponsored him, has met in Miami with the leadership of the Cuban-American National Foundation (CANF), the same “Foundation” that directed the attacks on Havana.
In a text referring to an interview given by Mafioso lawyer Arturo Hernández in the presence of the terrorist on Monday May 14, the Miami daily El Nuevo Herald, confidant of the Mafioso fauna, reports that the investigation by the Grand Jury in Newark is entering its final stage. It states that, “according to sources linked to the case,” it could produce “charges of financing actions that infringe the law of U.S. neutrality.” The Mafioso daily’s omission is more than significant. It does not allude to the real possibility of terrorism charges against the international criminal. Posada and his lawyers would be satisfied with the former conclusion from this lengthy investigation into the attacks in Havana that he directed from Central America, thanks to funding from the Cuban-American National Foundation (CANF). MAS SANTOS IN WASHINGTON On Thursday, August 24, 1998, the two principal CANF leaders visited the State Department with the aim of negotiating with high-ranking officials the imminent trial of two of their members in relation to the La Esperanza terrorist plot (to fire on the plane transporting Cuban President Fidel Castro to the Isle of Margarita for the 7th Ibero-American Summit). Jorge Mas Santos, son of the CANF founder, and Alberto Hernández, president of that organization’s executive, met with Deputy Secretary of State Stuart Eizenstat in order to prevent Francisco Pepe Hernández and José Antonio Llama, two leading members of the organization, from appearing in court. Despite the fact that FBI files revealed indicated how and where he had purchased that powerful weapon to be used in the assassination attempt, Pepe Hernández was never charged. Everything would indicate that the arrangement was to remove Pepe from the picture in order to save the Foundation’s image and leave Llama – the conspirators’ eternal victim “stuck” with the trial, in order to make the government’s position credible. However, another problem remained, the same that is now being seen in Newark. The defense lawyers were hoping that the charges presented against their clients would be in violation of the U.S. neutrality law: the sentences for such a charge are always negotiated to less than five years’ imprisonment. The Justice Department, represented by a lawyer known for being incorruptible – Miguel Pereira – maintained a firm position and accused the conspirators of an assassination attempt against a head of state and conspiracy to murder. This charge carries a maximum life sentence, the same as a charge of terrorism. Of course, the court, manipulated by the same Mafioso network that always protects Posada – implicated in the conspiracy but never brought to justice – released all the conspirators on bail and, at the end of the trial, exonerated them. One of the accused in the La Esperanza trial, Angel Alfonso Alemán, is currently an advisor to Congressman Albio Sires, who for years was mayor of the city of West New York, known in the region for being a sanctuary for Cuban-American criminals. WHAT WILL HAPPEN IN NEWARK THEN? It is now well known that the FBI possesses an enormous amount of evidence demonstrating that Posada Carriles and his accomplices engaged in acts of terrorism that resulted in the death of an Italian tourist, Fabio di Celmo, leaving a significant number of people wounded and causing considerable material damage. Will there be a charge of terrorism or conspiracy to commit acts of terrorism or will the District Attorney’s Office, directed by Alberto Gonzales’ Justice Department, confine itself to a charge of violating the law of neutrality? Everything indicates that the handling of political and Mafioso influences in the dossier has already been undertaken by the anti-Cuba mafia and its personnel. As in El Paso – where, in the initial stages, lawyer Eduardo Soto did not even attend the court, on the pretext of awaiting Washington’s response to his offers – in Newark, manipulations are underway around the Grand Jury and the New Jersey’s District Attorney’s Office as well as in the federal capital. If in New Jersey, the mafia’s legal “staff” fail to successfully “negotiate” as they did in El Paso, it remains for the Bush clan to go through the habitual time-wasting procedures to carry the issue over until after the 2008 elections, with the secret hope that in the meantime the terrorist leaves the island or that the case is definitively shelved. FLORES WITH HIS ACCOMPLICES On May 20 the CANF - that organized, directed and financed the attacks in Havana - received for its annual banquet on May 20 in Miami Salvadoran President Francisco Flores, who for years gave coverage to the terrorist activities promoted against Cuba from U.S. territory. Why did this “ex” come to Florida? El Salvador, where Posada conspired for more than a decade, benefiting from protection and impunity, remains as an alternative for the inopportune departure – legal or illegal – of the CIA agent, former security advisor to President Napoleón Duarte. Flores will always be remembered for having been the first leader to endorse the coup faction government of Pedro Carmona in Venezuela. This weekend, Flores received an effusive welcome from the CANF leadership and embraced Jorge Mas Santos, the president of its executive, and his alter ego, José Pepe Hernández. Pepe himself was opportunely saved in 1997 from the La Esperanza terrorist saga. And was the man who offered Percy Alvarado, Agent Fraile of Cuban State Security, $10,000 for “blowing up” the Tropicana cabaret. • TRIAL FOR TERRORIST’S FIVE ACCOMPLICES POSTPONED Meanwhile, in El Paso, the farce continues. Federal Judge David Briones has just ruled that the trial of five of Posada’s accomplices be postponed until August 20. The decision was made at the request of defendant and registered terrorist Ernesto Abréu. Initially, the start of the trial against him was set to begin May 29. Abréu is to be tried alongside two other close collaborators of Posada, Santiago Alvarez Fernandez-Magriñá and Osvaldo Mitat, who are serving sentences of four and three years, respectively, for illegal possession of weapons. The motive for the petition submitted to Briones: the defense and prosecution are “negotiating a solution” to the matter. In another episode of this scandalous legal saga, Judge Kathleen Cardone, the very same who recently freed Posada, this time ruled in favor of postponing the trial of 76-year-old José Hilario Pujol, and Rubén López Castro, 67 years, until August 22. For the same reason! “Negotiations” with the public ministry have allowed Alvarez and Mitat to improve their chances for release, by reducing their sentence thanks to the “additional” handing in of weapons. |
Miami: el complot continúa por Jean-Guy Allard Mientras los abogados de Posada maniobran en Newark, New Jersey, para evitar al asesino la acusación de terrorismo que provocaría su detención, el ex presidente salvadoreño Francisco Flores que lo apadrinó, se reunía en Miami con los cabecillas de la FNCA, esa misma "fundación" que orientó los atentados de La Habana. En un texto relatando una entrevista concedida por el abogado mafioso Arturo Hernández, en presencia del terrorista, el pasado 14 de mayo, el diario miamense El Nuevo Herald, confidente de la fauna mafiosa, reporta que la investigación del Gran Jurado reunido en Newark, se encuentra en su etapa final. Precisa que, "de acuerdo con fuentes vinculadas al caso", se podría arrojar cargos de financiamiento de acciones que transgreden la ley de neutralidad estadounidense. La omisión del rotativo mafioso es más que significativa. No alude a la posibilidad real de una acusación de terrorismo contra el delincuente internacional. Es que a Posada y sus abogados, les convendría tal conclusión de esa larguísima investigación consagrada a los atentados de La Habana que manejó, por cuenta de la Fundación Nacional Cubano Americana (FNCA), desde Centroamérica. MAS SANTOS EN WASHINGTON El jueves 24 de agosto de 1998, los dos principales líderes de la Fundación Nacional Cubano Americana visitaban el Departamento de Estado a fin de negociar con altos funcionarios el encauzamiento inminente de dos de sus directivos en relación con el complot terrorista de La Esperanza. Jorge Mas Santos, hijo del fundador de la FNCA, y el presidente de la junta directiva de esa organización, Alberto Hernández, se reunieron con el entonces subsecretario de Estado, Stuart Eizenstat, para evitar que Francisco "Pepe" Hernández y José Antonio Llama, dos directivos de la organización, aparezcan entre los acusados. A pesar del hecho que los propios archivos de la Oficina Federal de Investigaciones (FBI) indicaban dónde y cómo había comprado la potente arma en 1994, "Pepe" Hernández nunca fue inculpado. Todo indica que el arreglo, con los que sí deciden, fue sacar a Pepe, para salvar la imagen de la Fundación, y dejar a Antonio Llama, eterna víctima de los conspiradores, "embarcado" con el juicio, para hacer creíble la posición del gobierno. Sin embargo, quedaba otro problema, idéntico a lo que se observa ahora en Newark. Los abogados de los encausados esperaban que los cargos presentados contra sus clientes serían haber violado la Ley de neutralidad de Estados Unidos. Las condenas para tal delito siempre se negocian a menos de cinco años de prisión. El ministerio público, representado por un letrado conocido por incorruptible, Miguel Pereira, mantuvo una posición firme, y acusó a los conspiradores de intento de asesinato de un jefe de Estado y de conspiración de asesinato: esta acusación conlleva una sentencia máxima de cadena perpetua. Al igual que una acusación de terrorismo. Por cierto, el tribunal, manipulado por esa misma red mafiosa que siempre cubrió a Posada —implicado en el complot pero nunca denunciado ante la justicia— liberó a todos los acusados bajo fianza, y finalmente, les exoneró. Uno de los acusados de La Esperanza, Ángel Alfonso Alemán, es hoy día asesor del congresista Albio Sires quien fue, durante años, alcalde de la ciudad de West New York, conocida por ser, en la región, el santuario del hampa cubanoamericana. ¿QUÉ PASARÁ ENTONCES EN NEWARK? Es ahora bien conocido que el FBI posee muchas evidencias que demuestran que Luis Posada Carriles y sus cómplices realizaron actos de terrorismo caracterizados, que resultaron en la muerte de un joven turista, Fabio di Celmo, un importante número de heridos y daños materiales de consideración. ¿Aparecerá una acusación de terrorismo o de conspiración para cometer actos de terrorismo o... se limitará la Fiscalía, orientada por el Departamento de Justicia de Alberto Gonzales, a un cargo de violación de la Ley de neutralidad? Todo indica que el manejo de influencias políticas y mafiosas en el dossier ya ha sido emprendido por la mafia anticubana y su personal. Como en El Paso —donde al principio ni se presentaba, recuérdese, el abogado Eduardo Soto, pretextando estar en espera de respuestas de Washington a sus ofertas—, en Newark, las artimañas se desarrollan tanto alrededor del Gran Jurado y de la Fiscalía de New Jersey como en la capital federal. Si en New Jersey, el staff jurídico de la mafia no logra "negociar" con tanto éxito como en El Paso, le quedará al clan Bush recorrer a los habituales procedimientos dilatorios para llevar el tema hasta después de las elecciones del 2008, con el secreto deseo de que, entretanto, el terrorista salga del país o que la naturaleza archive definitivamente el caso. FLORES CON SUS CÓMPLICES Casualidad, sin duda, la FNCA que organizó, orientó y financió los atentados de La Habana, recibía este sábado en Miami, en su banquete anual del 20 de mayo, al ex presidente de El Salvador, Francisco Flores, quien durante años dio cobertura a las actividades terroristas promovidas contra Cuba. ¿A qué vino este "ex" a la Florida? El Salvador, donde Posada conspiró durante más de una década, beneficiándose de protección e impunidad, queda como alternativa para una salida intempestiva —legal o ilegal— del agente de la CIA, ex asesor de seguridad del presidente Napoleón Duarte. Flores siempre será recordado por haber sido el primer mandatario en avalar el gobierno golpista de Pedro Carmona, en Venezuela. Lo hizo con el mismo servilismo que lo había llevado a presentar, a solicitud de José María Aznar, una equívoca condena del terrorismo vasco en la Cumbre Iberoamericana del 2000 en Panamá, mientras se arrestaba a Posada. Este fin de semana, Flores recibió una ruidosa acogida de parte de la cúpula de la FNCA y abrazó con efusión a Jorge Mas Santos, el presidente de su junta directiva y a su alter ego... José "Pepe" Hernández. Este es el mismo Pepe que se salvó oportunamente, en 1997, de la saga asesina de La Esperanza, y quien ofreció a Percy Alvarado, el agente Frayle de la Seguridad Cubana, 10 000 dólares para "explotar" el cabaret Tropicana.
