Posada Set Free by Bush’s «Misconduct» Judge Cardone dimissed all charges against Posada. The Bush administration has ridiculed the values extolled by the American justice system. US citizens sympathetic with Cuba said demonstrations will continue by Marina Menendez Quintero
Seventy-two hours before the scheduled appearance of Luis Posada Carriles in an El Paso court for charges of lying about his illegal entry into the Unites States, an unexpected ruling by Judge Kathleen Cardone exempted the terrorist of seven charges related to lying to immigration authorities, leaving him free and unpunished. The decision again proves the weight of blackmail by Miami’s anti-Cuba and terroristic right-wing, but has also created fears in White House about the revelation of links between the terrorist to successive administrations, the CIA and the Bush clan. This connection explains the inaction by authorities, who —despite possessing all the evidence pointing to Posada Carriles as a terrorist— refused to accuse him of terrorism. Judge Cardone raised this in her 38-page verdict calling the tactics of the government to try Posada «grossly shocking » and «outrageous». She said that the court had no choice but dismiss the case. In insisting that this evidence should have been provided by the prosecution to try Posada as the terrorist he is, the judge called the actions «misconduct» on the part of the executive branch. « As with each and every defendant who comes before this court, (the) defendant in this case is entitled to certain rights under the United States Constitution. This court will not set aside such rights nor overlook government misconduct because defendant is a political hot potato. » One should bear in mind that the decision came after the «confrontation» between the government and Posada’s lawyers regarding his links with the CIA. The prosecutors, warned by the defence that they were ready to divulge everything, issued a motion prohibiting Posada Carriles from making any allusion to those links in the Friday hearing. The terrorist replied through his lawyers by confirming his links to the agency after 1976, but also through a motion in which he challenged the accurate translation of the interview he had with the immigration authorities in April, 2006. His statements in that interview, a part of his application for citizenship, were why Posada was accused of lying. The ruling by the judge is the response to Posada’s defence to reject those statements. Cardone said the translation of his interview was extremely vague and unreliable. She accused the government of improperly manipulating «the administration of criminal justice in order to secure a criminal indictment(s) against defendant. » In other words, the Bush administration was attempting to have her assume the cost of the political problem posed by the presence of Posada Carriles in the United States. According to reports, Posada will travel back to Miami today, although there is a probability of an appeal by the prosecution. Likewise, still pending are charges in New Jersey to try the terrorist for his known role in acts of sabotages against hotels in Cuba in 1997. In addition, Venezuela continues to request his extradition. «We are reviewing the ruling, » said Dean Boyd, spokesperson of the Justice Department in Washington. Meanwhile, Marc Raimondi, the Immigration and Customs Office spokesperson, said he was aware of the dismissal and announced that department would take «appropriate actions. » The sudden ending of a trial in which the Bush administration had pretended to show concern for the exercise of justice, while they actually restricted it, —as Judge Cardone complained in her ruling— took place the same day Democratic representative William Delahunt posed a question in a letter sent to General Attorney Alberto Gonzales asking why Posada was not tried for terrorism. «This places in doubt the commitment of the US to combat terrorism, » wrote Delahunt. He, along with other representatives, plans to hold a hearing about the tactics employed by the administration in this trial.

A 72 horas de la prevista comparecencia de Luis Posada Carriles ante el tribunal de El Paso por mentir acerca de su entrada ilegal a Estados Unidos, un intempestivo dictamen de la jueza Kathleen Cardone eximió al terrorista de esas pocas culpas materializadas en siete cargos, y lo dejó impune y libre. La decisión exhibió otra vez la presión del chantaje de la derecha anticubana y terrorista de Miami, pero también los temores de la Casa Blanca a que salieran a la luz los vínculos de sucesivos gobiernos, de la CIA, y del propio clan Bush con el terrorismo de Estado planeado desde Washington, y del que Posada fue uno de los ejecutores. Ello explica la inacción de las autoridades que, estando en posesión de todas las pruebas que incriminan a Luis Posada Carriles como terrorista rehusaron acusarlo como tal, lo que fue reprochado por la propia jueza Cardone en su dictamen de 38 páginas al calificar de «increíblemente escandalosas» y «ofensivas» las tácticas del gobierno para encausar a Posada. «A este tribunal no le queda otra alternativa que desestimar el encausamiento», sentenció. Al insistir en la falta de las pruebas que debió suministrar la Fiscalía para juzgar a Posada como lo que es, la magistrada calificó de «mala conducta» la actuación del ejecutivo: «Como todos los acusados ante un tribunal, este acusado está protegido por ciertos derechos constitucionales. Este tribunal no va a echarlos a un lado ni ignorará la mala conducta del gobierno solo porque el acusado sea una papa caliente en términos políticos». No debe perderse de vista que la decisión tiene lugar luego del «careo» que sostuvieran el gobierno y los abogados de Posada en torno a sus vínculos con la CIA cuando la Fiscalía, avisada por la defensa de que estaba dispuesta a hablar, emitió una moción en la que prohibía a Posada hacer alusión a esos vínculos en la vista del viernes. El terrorista respondió por medio de sus abogados ratificando las relaciones con la Agencia después del año 1976, y con una moción donde impugnaba la entrevista que le realizaran las autoridades migratorias, en abril de 2006, a tenor de su solicitud de ciudadanía, y en virtud de la cual se acusaba a Posada de mentir. Ahora, el dictamen de la jueza da respuesta al pedido de la defensa de que se desestimaran aquellas declaraciones. La traducción de esa entrevista es imprecisa y no digna de confianza, afirma Cardone, quien acusó al gobierno de manipular de manera improcedente «la administración de la justicia criminal para conseguir una instrucción de cargos criminales contra el acusado». O, lo que es igual: de pretender que ella asumiera todo el costo del problema político que significa para la administración Bush, la presencia de Posada Carriles en Estados Unidos. Según se informó, Posada viajaría hoy de regreso a Miami, aunque existe la probabilidad de una apelación de la Fiscalía, y quedan pendientes las gestiones de un jurado de Nueva Jersey para encausar al terrorista por su también probada responsabilidad en los atentados perpetrados contra hoteles cubanos en el año 1997. Además, Venezuela sigue reclamando la extradición. «Estamos revisando la decisión», afirmó Dean Boyd, vocero del Departamento de Justicia en Washington, en tanto Marc Raimondi, vocero de la Oficina de Inmigración y Aduanas, declaraba estar al tanto de que la acusación había sido eliminada y anunciaba que tomarían «las acciones apropiadas». El desenlace abrupto de un proceso con el cual la administración Bush ha tratado de aparentar que está interesada en el ejercicio de la justicia cuando en verdad la ha coartado —como se queja en su dictamen la jueza Cardone—, tuvo lugar el mismo día en que el legislador demócrata William Delahunt cuestionó, en carta dirigida al Fiscal General, Alberto Gonzales, que Posada no fuera encausado como terrorista. Ello «pone en duda el compromiso de EE.UU. de combatir el terrorismo», dijo Delahunt quien, al frente de otros legisladores, planea la celebración de una audiencia congresional sobre el comportamiento del gobierno en este proceso.
