Three of the Cuban Five in Miami for Resentencing

HAVANA, Cuba, Aug 31 (ACN) - Three of the five Cuban antiterrorists unjustly incarcerated in the US were taken to the Miami detention center to wait for a re-sentencing hearing scheduled for October 13th. Last year, the Eleventh Circuit Court of Appeals of Atlanta ruled that the sentences given to Ramón Labañino, Antonio Guerrero and Fernando Gonzalez were imposed incorrectly and sent them back to Judge Joan Lenard who, in the presence of a jury, will have to give them new sentences. Ramon Labañino and Antonio Guerrero are serving life terms while Fernando Gonzalez was sentenced to 19 years. The two other Cuban antiterrorists, Gerardo Hernandez and Rene Gonzalez, who are serving two-life terms and fifteen years, respectively, were not benefited with the re-sentencing ordered by the Atlanta appeals court. The Cuban Five, as they are known internationally, were arrested by FBI agents in September 1998 for having infiltrated anti-Cuban terrorist organizations and were tried in 2001 in Miami, in the middle of a hostile environment. The biased trail led to unfair and extremely hard sentences on charges that were never proved, as the Atlanta court had to admit. For over a decade, the Cuban Five have received harsh treatments in US The international campaign for their release has spread all over the world, where hundreds of solidarity committees and organizations have been created for that purpose. National Parliaments, scholars, renowned figures, including 10 Nobel Prizes, among others, have pleaded for their immediate release.

Ramón Labañino, Antonio Guerrero y Fernando González ya se encuentran en el Centro de Detención Federal de Miami, para asistir a la vista por la resentencia que tendrá lugar el 13 de octubre, de acuerdo con el sitio www.freethefive.org. Ante la misma jueza que en el 2001 condenó a los Cinco, Joan Lenard, un jurado tendrá que tomar en cuenta las instrucciones de un tribunal de apelaciones —Onceno Circuito de Atlanta— que ha indicado “que las sanciones fueron impuestas incorrectamente” y en consecuencia las anuló. Coinciden los abogados en la preocupación de Tony, Ramón, Fernando y René por la situación de Gerardo, pero Thomas Goldstein, experto en litigio ante la Corte Suprema, opinó en una reciente visite a La Habana que los esfuerzos que se harán demostrarán que la condena de conspiración para cometer asesinato por la cual este tiene una de las dos cadenas perpetuas es “totalmente absurda”. Dentro de la arbitrariedad e ilegalidad de este caso, el tratamiento que ha recibido Gerardo es todavía la injusticia mayor, coincidieron los abogados del caso. René González tampoco fue favorecido para la resentencia. Phillip Robert Horowitz, el abogado de René, sostuvo que a estas alturas su defendido está al cumplir 15 largos años en prisión, donde ha mantenido, al igual que los otros, un excelente comportamiento. Por tal motivo no oculta la admiración hacia René, quien pese a todo “mira hacia adelante para regresar a su casa, a su esposa, a sus hijas”. En “aproximadamente dos años” expira la condena que le fue impuesta en el 2001, acotó Horowitz. Además, de los “tres años de libertad supervisada, lo cual es el equivalente a la libertad condicional”, señaló. |
