On Wednesday June 4th, the 11th U.S. Circuit Court of Appeals announced its ruling in the appeal case for the Cuban Five.

In the 99-page opinion, the three-judge panel unanimously upheld the convictions against the Five Cuban Patriots. The court also upheld the sentences given to René González (15 years) and Gerardo Hernández (two life sentences plus 15 years).

The court’s ruling on Gerardo’s sentence, however, was not unanimous: 2 to 1. On page 16 of the written opinion, Judge Phyllis Kravitch states that the government did not present sufficient evidence to convict Gerardo of conspiracy to commit murder.

The sentences of Ramón Labañino (life plus 18 years); Fernando González (19 years) and Antonio Guerrero (life plus 10 years) were returned to Judge Joan Lenard’s Florida court for re-sentencing. Lenard will need to call for a hearing to issue the new ruling — this is the same judge who imposed the excessive and unjust sentences in 2001.

The Atlanta Appeals Court’s written opinion, which employs startling political rhetoric, states that the defense’s arguments lacked merit and clearly favors the government.

The court’s ruling exposes various contradictions between the opinions of two of the justices and the author of the opinion, Judge William H. Pryor, an ultraconservative appointed to the bench with the help of Republican John McCain despite opposition from the Senate.

The defense attorneys, Weinglass, MacKenna and Horowitz, ensured they will continue the legal battle that began in December 2001 when they were unjustly sentences. There are still some legal avenues open.

Given the United States’ governments’ legal ploys to expand the sentences of our Five Brothers, we are not surprised by the judicial ruling. On the contrary, it reaffirms our need to continue fighting tirelessly to denounce this colossal injustice.

Exposed once again is the contempt of the United States government, which yesterday, in another U.S. city, defended the criminal Luis Posada Carriles. A man who, rather than fittingly declaring him a terrorist for his crimes against humanity and extraditing him to Venezuela where the government has declared Carriles a fugitive and repeatedly demanded his extradition, the U.S. government has granted him full liberty.

Gerardo is not surprised by the ruling. "This is the same system that has unjustly incarcerated Mumia for more than 20 years along with Leonard Peltier and the Puerto Rican political prisoners," he said today. "We will endure as many years as necessary, 30, 40, whatever it takes. As long as one of you is resisting, we will also resist until there is justice."

Gerardo has asked that we communicate his confidence to all of you, "For anyone who asks, tell them I am fine, strong and always looking forward."

Along with all of our friends around the world we call for mobilizations beginning on the morning of June 6, in front of all headquarters of the terrorist U.S. government —in Europe, Latin America and the U.S. — which holds our Five Brothers imprisoned.

Only solidarity, constant condemnation and international mobilization will secure freedom for the Five.

El pasado 4 de Junio, la corte de apelaciones del Onceno Circuito de Atlanta dio a conocer su dictamen sobre el recurso de apelación presentado por la defensa.

En un escrito de 99 páginas, y por decisión unánime, los tres jueces reafirmaron los cargos de culpabilidad contra los Cinco Patriotas Cubanos y anuló las sentencias de tres de ellos que deberán ser sentenciados nuevamente.

Ratificaron las sentencias de René González (15 años de prisión) y Gerardo Hernández (dos cadenas perpetuas más 15 años).

Sobre Gerardo, la decisión del panel no fue unánime sino 2-1. La jueza Kravitch expresa en 16 páginas que el gobierno no presentó las pruebas suficientes para acusar a Gerardo de conspiración para cometer asesinato.

Los casos de Ramón Labañino (cadena perpetua más 18 años), Fernando González (19 años) y Antonio Guerrero (cadena perpetua más 10 años) fueron enviados a la jueza Joan Lenard del Tribunal de la Florida para que proceda a re-sentenciarlos.

Lenard deberá convocar una audiencia para emitir el nuevo fallo. Esta jueza es la misma que impuso las graves e injustas condenas a los Cinco en el 2001.

La corte de Atlanta dictaminó que los argumentos de la defensa carecían de mérito. Asombran los términos políticos empleados en el fallo de la corte, ajenos a las instancias legales y favoreciendo al gobierno.

El fallo de los jueces deja abierta varias contradicciones entre las opiniones de dos de ellos y el escrito redactado y firmado por el juez Pryor. Un juez ultraconservador que consiguió su nombramiento gracias al actual candidato republicano McCain a pesar de la oposición del Senado.

Los abogados de la defensa: Weinglass, MacKenna, Horowitz, afirmaron continuar la batalla legal iniciada en diciembre del 2001 cuando fueron injustamente condenados. Legalmente hay caminos a seguir.

Más allá de todas las artimañas legales del gobierno de EE.UU. para dilatar la injusta prisión de nuestros Cinco Hermanos, no sorprende la decisión judicial, al contrario, nos reafirma mucho más en la necesidad de continuar luchando sin descanso para denunciar esta colosal injusticia.

Una vez más se pone al desnudo el cinismo del gobierno norteamericano que en el mismo día de ayer, en otra ciudad de EE.UU., continuó su farsa para proteger al criminal Luis Posada Carriles, quien disfruta de total libertad, en lugar de certificarlo como terrorista por sus crímenes contra la humanidad y extraditarlo a Venezuela, cuyo gobierno lo reclama desde hace 3 años por ser prófugo de ese país.

Para Gerardo, la decisión no lo ha sorprendido: "este es el mismo sistema de justicia que tiene encarcelado por más de 20 años a Mumia, a Leonard Peltier, y a los presos políticos puertorriqueños", nos dijo esta mañana. "Nos echaremos los años que hagan falta, 30, 40, lo que sea, mientras quede uno de ustedes afuera resistiendo nosotros también vamos a resistir hasta que se haga justicia".

Gerardo nos pide que trasmitamos a todos su confianza: "a todos los que pregunten digan que estoy bien, con mucha fuerza y siempre pa¢ lante."

Junto a todos nuestros amigos, comités y hermanos del mundo llamamos a redoblar el reclamo por ellos movilizándonos a partir de mañana 6 de junio (hoy) de todas las maneras posibles, como lo harán en EE.UU., Europa y América Latina, frente a las sedes del gobierno terrorista de EE.UU. que mantiene en prisión a nuestros Cinco Hermanos.

Solo la solidaridad, la denuncia constante y la movilización internacional logrará la libertad de los cinco
