THE Cuban Parliament’s Foreign Relations Commission yesterday unanimously approved a statement condemning the ruling issued by the 11th Circuit Court of Appeals in Atlanta, Georgia, in which a panel of three judges upheld the convictions of five Cuban anti-terrorist fighters imprisoned in the United States and the sentences of two of these men, while mandating the cases of the other three for re-sentencing in a new hearing in Miami.

During a special meeting, the legislators agreed to send the statement to their counterparts around the world so that they might be informed of, denounce and take action against the continuing injustice.

"We are going to appeal; we are going to request that the panel review its action. We propose to use all the elements and arguments. We are going to appeal to the Atlanta Circuit Court’s full plenum of judges and the U.S. Supreme Court," said Ricardo Alarcón de Quesada, president of Parliament, explaining the content of the 99-page ruling to deputies and pointing out that the only convictions and sentences upheld were those of two defendants, Gerardo Hernández Nordelo (two life sentences plus 15 years) and René González Sehwerert (15 years).

"This is no accident," added Alarcón. Gerardo is the only one accused of conspiracy to commit murder (the charge which gives the case its political content) and René was able to infiltrate the terrorist organization Brothers to the Rescue, which sent the aircraft downed by the Cuban armed forces over national territory in February of 1996, in legitimate defense of the country’s sovereignty.

"There was a very clear manipulation of the events in order to build a case against Gerardo," he explained. This charge was not the original accusation; it was added seven months later and "became the prosecution’s centerpiece," he said.

Alarcón, also a member of the Cuban Communist Party’s Political Bureau, recalled that the very same judges recognized the errors committed at the original sentencing in Miami.

He called for building solidarity and reminded the group that in order to win this battle, unity is fundamental, as the Cuban Five have shown. "We have to continue the fight until the end, together," he concluded.

La Comisión de Relaciones Internacionales del Parlamento aprobó la víspera por unanimidad una Declaración de condena contra el fallo de la Corte de Apelaciones del Onceno Circuito de Atlanta, Georgia, en la que un panel de tres jueces de esa instancia judicial ratificó el veredicto de culpabilidad de los Cinco antiterroristas cubanos prisioneros en cárceles de Estados Unidos, ratificó la sentencia a dos de ellos y solicitó una resentencia para los otros tres en una nueva audiencia en Miami.

En reunión extraordinaria, el grupo parlamentario acordó elevar este pronunciamiento a todos sus similares del mundo para que se conozca, denuncie y actúe contra la continuidad de la injusticia.

"Vamos a apelar, vamos a solicitar al panel que revise su actuación. Nos proponemos utilizar todos los elementos y argumentos. Vamos a apelar al pleno de los jueces de la Corte de Apelaciones del Circuito de Atlanta y al Tribunal Supremo de EE.UU.", expresó Ricardo Alarcón de Quesada, presidente del máximo órgano legislativo, al explicar ante los diputados el contenido de las 99 páginas de la reciente decisión de Atlanta y cómo a los únicos que se les mantuvieron tanto los cargos de culpabilidad como el castigo fueron a Gerardo Hernández Nordelo (doble cadena perpetua más 15 años) y a René González Sehwerert (15 años).

"Algo que no es casual", acotó Alarcón. El primero es el único acusado por el cargo tres (conspiración para cometer asesinato, el que da el ingrediente político a esta causa) y el segundo, había logrado penetrar la organización terrorista Hermanos al Rescate, de donde eran las avionetas derribadas por el Gobierno cubano en territorio nacional, en febrero de 1996, en legítima defensa de su soberanía.

"Para construir la acusación contra Gerardo hubo una clarísima manipulación de los hechos", precisó. Dicho cargo no estaba en la acusación original, se agregó siete meses después y "se convirtió en el centro del proceso", señaló.

El también miembro del Buró Político recordó que los propios jueces han reconocido los errores cometidos a la hora de dictar sentencia en Miami. Por otra parte, llamó a promover la solidaridad y recordó que para ganar en esta batalla es fundamental la unión. La misma que han manifestado los Cinco. "Hay que seguir en la batalla hasta el final, juntos", concluyó.
