An unforgettable hearing

Miami— The recent hearing held in Miami to reduce the sentence of Antonio Guerrro was the first of the court hearings in the judicial process imposed on the Cuban Five which I attended. I was one of those present, the principal reason being, I wanted to know Antonio personally.
And there in front, with his back facing us, we were with him for almost four hours. He entered through a side door at the front of the courtroom. We accompanied his mother and sister as we were in attendance to support him. He looked at us with satisfaction and aplomb, as he walked—with his ankles in chains—toward his place at a table, with his eminent attorney Leonard Weinglass at his side.
At no time is the prisoner permitted to establish contact with other people in the courtroom, not even with eye contact, except with his attorney. What a terrible punishment that verges on torture. For that reason Antonio must have felt more pressure and frustration during the hearing.
Antonio looks his age. Precisely today he turns 51 years old. And as Weinglass reminded the judge during the hearing, he has been imprisoned and isolated from his loved ones for 11 years—the last seven of them in a maximum-security prison—since he was 39 years old, "the heart of his life," as Weinglass eloquently characterized the long years Antonio has suffered in prison.
He is pale, due to lack of sun, part of the cruel daily regimen in that type of prison. He remains slim and a bit fragile physically. Those who know him intimately say this is normal for him. During the course of the hearing he remained calm and firm. He radiated the serenity of one who is conscious of his responsibility to his people and to history, the same way his other four brothers have so courageously demonstrated.
There are two issues regarding the hearing that I should address. The first is the reason behind the agreement between the defense and the prosecution, which recommended to the court that his new sentence be 20 years in prison. I want to make clear that that agreement has nothing to do with the false charge claimed by the U.S. government against Antonio, of conspiracy to commit espionage.
The agreement dealt solely with the life sentence that was arbitrarily imposed on Antonio for that charge. It was an accord that obligated the terrible judge Joan Lenard—who presided over the trial in 2001 and gave the Five those barbarous sentences—to give Antonio 21 years and 10 months of prison. That is the minimum recommended in the Federal Sentencing Guidelines. For everyone present in the court it was obvious that Judge Lenard was writhing in her seat with rage, because the circumstances did not allow her to impose an even more severe sentence.
The rightwing was furious--knowing that in the worst case scenario Antonio will now leave prison in about seven years, instead of being imprisoned for the rest of his life--and is lying by shamefully claiming that Antonio acknowledged his guilt in accepting the agreement. The agreement dealt solely with the sentence. Nothing more.
The second issue is really surprising. It is the explanation of the prosecutor—the U.S. government prosecutor—U.S. assistant attorney Caroline Heck Miller (the same one who represented the U.S. government in the Five's trial), of the reason the prosecution reached an agreement with Antonio's attorney for the 20-year sentence recommended by both parties.
The reasons are of a political nature, neither judicial nor humanitarian. It is the recognition by the U.S. government that public opinion, in this country and around the world, is adverse and condemnatory of it. This is because of the deceitful and arbitrary judicial process against the Five and their subsequent convictions. The opinion being of such magnitude that the interests of the United States are harmed. I am not exaggerating in the slightest her extraordinary declaration.
So it was that judge Lenard, furious with the prosecutor, reprimanded her, telling her, how is it possible for her to take that position now, when for six months during the trial in 2001, she characterized Antonio as a dangerous enemy whose actions had put the national security in danger. According to her, that was the basis for finding him guilty of conspiracy to commit espionage, and why he was sentenced to life.
It was in that moment in the hearing that all the lies against the Five became evident. The government exposed the fact that this has always been a political process that has nothing to do with the truth.
The statement by prosecutor Heck Miller is obvious recognition of the success of the results obtained by the political movement throughout the world, which for all these years has denounced the arbitrary and mendacious process pursued by the U.S. government against the Five. The movement has been unwavering in its demand for their immediate freedom. Now more than ever this movement must redouble its efforts until they are free.

Una audiencia memorable

Miami.- La reciente audiencia celebrada en Miami de reducción de condena de Antonio Guerrero fue la primera de las audiencias en el proceso judicial impuesto a los Cinco a la que he asistido estando uno de ellos presentes. El motivo principal que quise estar presente en ésta es que quería conocer personalmente a Antonio.
Y ahí al frente y de espaldas a nosotros lo tuvimos por espacio de casi cuatro horas. Entró por una puerta lateral situada hacia el frente de la sala, y a todos nosotros que nos encontrábamos al fondo de la sala, que acompañando a su madre y a su hermana estábamos presentes para apoyarlo, nos miró con satisfacción y aplomo, mientras caminaba con sus tobillos encadenados hacia su puesto frente a una mesa al lado de su eminente abogado, Leonard Weinglass.
En ningún momento al preso le es permitido establecer contacto alguno con otras personas en la sala, siquiera visual, con excepción de su abogado. Terrible castigo este que hiede a tortura. Más presión y frustación por esa razón tenía que haber sentido Antonio durante la audiencia.
Antonio aparenta su edad. Hoy precisamente cumple 51 años de vida. Y como durante la audiencia Weinglass le recordara a la jueza, ha estado preso y aislado de sus seres queridos durante once años, los últimos siete de éstos en una prisión de máxima seguridad: desde sus 39 años, “el corazón de su vida”, como elocuentemente calificara Weinglass a estos largos años de la vida de Antonio sufrida en prisión.
Está blancuzco, debido a la falta de sol, parte del cruel régimen diario en ese tipo de cárceles. Permanece delgado y un tanto físicamente frágil, lo que se me afirma por quienes íntimamente lo conocen, que es normal en él. Durante el transcurso de la audiencia se mantuvo ecuánime y firme. Irradía la serenidad de aquel que está consciente de su responsabilidad con su pueblo y ante la historia, como, de la misma manera siempre han gallardamente demostrado, sus otros cuatro hermanos.
Hay otras dos cuestiones en relación a esta audiencia que debo tratar.. La primera es la razón por el acuerdo entre la defensa y la fiscalía, el cual recomendaba al tribunal que su nueva condena fuese 20 años de prisión. Debe estar claro que este acuerdo nada tiene que ver con el cargo falsamente imputado por el gobierno de Estados Unidos a Antonio por Conspiración para Cometer Espionaje.
Este acuerdo solamente tiene que ver con la condena a cadena perpetua que arbitrariamente se le impuso a Antonio por ese cargo. Acuerdo que obligó a la terrible jueza Joan Lenard --quien presidio el juicio en el 2001 y les impuso a los Cinco esas bárbaras condenas— a imponerle esa tarde a Antonio 21 años y 10 meses de prisión, el límite mínimo recomendado por la guía federal de condenas. A todos presentes en la sala fue evidente que la jueza Lenard se retorcía de rabia porque, obligada por las circunstancias, no pudo imponerle a Antonio una condena más cruel aún.
Miente la derecha, enfurecida al saber que en el peor de los casos Antonio ahora saldría de prisión en aproximadante siete años --en vez de poder mantenerlo encarcelado por el resto de su vida como era el propósito de su condena anterior— al afirmar desvergonzadamente que Antonio reconoció su culpabilidad al aceptar ese acuerdo. El acuerdo sólo tuvo que ver con la condena. Nada más.
La segunda cuestión a tratar es realmente asombrosa. Es la explicación de la fiscalía –del gobierno de Estados Unidos— descrita por la fiscal, Caroline Heck Miller, la misma fiscal que representó al gobierno en el juicio seguido contra los Cinco, de las razones por las cuales la fiscalía llegó al acuerdo con el abogado de Antonio sobre la condena de 20 años recomendada por ambas partes al tribunal.
Las razones son de carácter político y no de carácter jurídico ni humanitario. Es el reconocimiento por parte del gobierno de Estados Unidos que la opinión pública, en este país y en el mundo, le es adversa y condenatoria como resultado de la naturaleza falaz y arbitraria del proceso judicial mantenido en contra de los Cinco y de sus resultantes condenas. Estado de opinión que es de tal magnitud que daña los intereses de Estados Unidos. En nada exagero su extraordinario pronunciamiento.
Tal es así que la jueza Lenard enfurecida con la fiscal la increpó diciéndole que cómo era posible que ella mantuviera ahora esa posición cuando por seis meses, durante el transcurso del juicio, en el 2001, calificó a Antonio de peligroso enemigo cuyas acciones había puesto en peligro la seguridad nacional, y que fue la base de habérsele encontrado culpable del cargo de Conspiración para Cometer Espionaje y por tal condenado por la propia jueza Lenard a cadena perpetua.
Es así como en ese momento en esta audiencia se hicieron evidentes todas las mentiras en contra de los Cinco. El gobierno puso al descubierto que éste siempre ha sido un proceso político que nunca tuvo que ver con la verdad.
La afirmación de la fiscal Heck Miller es un evidente reconocimiento al éxito de los resultados obtenidos por el movimiento político en todo el mundo que por todos estos años ha venido denunciando el carácter arbitrario y mendaz de este proceso seguido por parte del gobierno de Estados Unidos en contra de los Cinco e inalterablemente exigiendo su inmediata libertad. Ahora más que nunca este movimiento tiene que redoblar sus esfuerzos hasta verlos libres.
