Current Legal Status of the Cuban Five
Regardless of the unjust prison sentences of Gerardo Hernández, Ramón Labañino, Antonio Guerrero and Fernando González, and René González's parole in the U.S., all supporters of the Cuban Five are fighting for their immediate freedom and right to return home to Cuba. We do not accept their sentences as final. 1. As of March 28, 2012, four of the Cuban Five—Gerardo Hernández, Ramón Labañino, Antonio Guerrero and Fernando González—are in the midst of their Habeas Corpus appeals. Motions have been filed by their attorneys, seeking evidence that the U.S. government withheld, and asking the judge to grant evidentiary hearings. Judge Joan Lenard, who presided over the trial, will make her decision on their appeals; there is no timeframe for the decision. Click here to read their briefs and other legal documents in the case. 2. Gerardo Hernández is serving two life sentences. Under U.S. federal prison sentencing, there is no parole with a life sentence. Read his habeas corpus documents, including a crucial Affidavit which documents his actual innocence in the false "murder conspiracy" conviction. 3. René González was released from Marianna Federal Correctional Institution in Florida, on Oct. 7, 2011 after serving more than 13 years. However, Judge Lenard ordered him to serve a 3-year probation in the United States. On May 5, 2013, while René was on a court-approved 2-week trip to Cuba for his father's memorial service, the court finally allowed René to remain in Cuba after renouncing his U.S. citizenship.
