Habeas corpus in Favor of Gerardo Hernandez May 14, 2010
The appeal lodged in favor of Hernandez, who was given two life sentences plus 15 years in prison, will be made to Judge Joan Lenard, from the Miami Federal Court, who sentenced him along with another four Cuban antiterrorists in 2001. The defense hopes the case of Hernandez -who was given the longest sentences as a result of a long and arbitrary trial- will be reconsidered, the Cubadebate Web site reports on Friday. Hernandez and Rene Gonzalez (condemned to 15 years) were excluded from the re-sentencing process carried out at the end of 2009 in Miami, in which Ramon Labañino, Antonio Guerrero and Fernando Gonzalez received new sentences. With the habeas corpus in favor of Hernandez, confined to a maximum security penitentiary in Adelanto, California, defense lawyers hope that the court eliminates, at least, his two life imprisonments. In a statement issued after the re-sentencing process, Labañino, Guerrero and Gonzalez reiterated their innocence and expressed that The Five were punished for charges that have never been proved. El recurso a favor de Hernández, condenado a doble cadena perpetua más 15 años, se interpondrá ante la jueza Joan Lenard, de la Corte Federal de Miami, quien en 2001 lo sentenció junto con otros cuatro antiterroristas cubanos. La defensa aspira a que sea reconsiderado el caso de Hernández, sobre quien pesan las penas más largas, resultado de un dilatado y arbitrario proceso judicial, expresa hoy el sitio Cubadebate. Hernández y René González (condenado a 15 años) fueron excluidos del proceso de resentencia realizado a fines del 2009 en Miami, en el cual Ramón Labañino, Antonio Guerrero y Fernando González, recibieron nuevas sanciones. El habeas corpus a favor de Hernández, confinado en una penitenciaría de máxima seguridad en Adelanto, California, pretende que el tribunal le elimine, al menos, las cadenas perpetuas. En una declaración tras la resentencia, Labañino, Guerrero y González reiteraron su inocencia y manifestaron que Los Cinco fueron castigados por acusaciones que jamás fueron probadas. Aunque tres sentencias fueron reducidas parcialmente, la injusticia se mantiene con todos, plantearon en el texto. Llamaron la atención sobre el caso de Hernández, porque el gobierno de Estados Unidos conoce la falsedad de las acusaciones contra él y lo injusto de su condena. Los cinco patriotas penetraron organizaciones terroristas que con total impunidad existen en Miami, con el objetivo de alertar y prevenir acciones criminales contra Cuba. La Fiscalía, durante la resentencia, reconoció públicamente la existencia de un fuerte movimiento mundial en respaldo a su liberación.
